Those Killed by the Trapped Lion

833. Imam al-Sadiq (AS) said:

“A group of people in Yemen dug a hole to trap a lion. The lion fell into it.

When people gathered around to look at the lion,

a man fell into the hole,

but he hung on to another man.

That man hung on to a third one, and the third to, a fourth.

The lion mauled them

so that some were savaged to death

and some others were pulled out (alive) but died as a result of the injuries.

They argued about this until they raised the swords.

The Commander of the Faithful (AS) said:

‘Come so that I may judge between you:

the first person should be given a quarter of the blood money,

the second person a third,

the third person a half,

and the fourth person the whole blood money.’

When the law was placed before the tribes who had gathered,

some of them were pleased with it while others were displeased.

When the news reached the Prophet (SA)

and he was informed of the judgement of the Commander of the Faithful (AS),

he approved it.”

A Man’s Bull Kills Another Man’s Donkey

834. Imam al-Baqir (AS) said:

“A man came to the Messenger of God (SA)

and said: ‘The bull of so and so killed my donkey.’

The Prophet (SA) said to him:

‘Go to Abu Bakr and ask him [to pass judgement].’

The man came to him and asked him,

so he said: ‘There is no penalty on animals.’

He returned to the Prophet (SA) and informed him about Abu Bakr’s judgement.

The Prophet (SA) said to him:

‘Go to Umar and ask him.’

The man came to him and asked him.

He passed the same judgment of Abu Bakr.

The man returned to the Prophet (SA) and informed him [about his judgement].

Then the Prophet (SA) said to him:

‘Go to Ali (AS) and ask him.’

He came to him and asked him,

so Ali (AS) said:

‘If the bull entered on the donkey while it was asleep and killed it‚

then its owner would be liable;

however, if the donkey entered on the bull in its sleep,

then its owner would not be liable.’

The man returned to the Prophet (SA) and informed him,

so the Prophet (SA) said:

‘Praise be to God who has appointed a member of my household judge according to the judgements of the prophets.’ ”

A Man Drinks Wine Unaware of Its Prohibition

835. Imam al-Sadiq (AS) said:

“The Commander of the Faithful - may God’s blessings be upon him - passed judgement on a matter on which none before him passed judgement!

It was the first case he judged after the demise of the Messenger of God (SA).

When the Messenger of God (SA) passed away, and Abu Bakr took over the authority, a man who had drunk wine was brought to him.

Abu Bakr said to him: ‘Did you drink wine?’

The man said: ‘Yes.’

He said: ‘Why did you drink it knowing that it was prohibited?’

He said: ‘When I became a Muslim,

I lived among a people who drank wine and considered it permissible,

so I did not know it was prohibited that I may abstain from it.’

Abu Bakr turned to Umar and said:

‘What do you say, O Abu Hafs, concerning this man?’

He said: ‘It is a complicated matter, so, leave it to Abu al-Hasan.’ [That is ‘Ali.]

Abu Bakr said: ‘O servant, call Ali for us.’

Umar said: ‘A judge should be visited in his house.’

Thus they came to him and [found] Salman al-Farisi with him.

They informed him about the story of the man and he related his story to him.

Ali (AS) said to Abu Bakr:

‘Send with him one to go around the gatherings of the Muhajirin and the Ansar;

if there is one who recited the verse of wine prohibition for him, he should bear witness;

if there is none who recited the verse of prohibition for him, let him go.’

Abu Bakr acted according to what Ali (AS) said. When none bore witness against him, he let him go.”

A Woman Gives Birth to a Baby Six Months after Her Husband’s Return

836. Al- Manaqib, by Ibn Shahr Ashub relates:

“Haytham was in the army;

when his wife gave birth to a child six months after he had returned,

he denied his paternity and brought the child to Umar complaining about her.

Umar commanded that she be stoned.

Ali caught up with her before she could be stoned.

He then said to Umar: ‘Restrain yourself; she spoke the truth.

God says: ‘And his gestation and weaning take thirty months’ Qur’an, 46:15.

and says:

‘Mothers shall suckle their children for two full years’ Qur’an, 2:233

Thus the period of gestation and weaning is thirty months.’

So Umar said: ‘If it had not been for Ali, Umar would have perished.’ He let her go and attached the child to the man.”

Two Men Collude to Swindle a Woman out of Money

837. Al-Kafi, reporting from Zadhan, who said:

“Two men entrusted a woman [with] a trust and said to her:

‘Do not hand it over to one of us until we are brought together with you.’

They then left and stayed away.

One of them came to her and said to her:

‘Give me my trust, for my friend died.’

She refused until he insisted on her, so she gave it to him.

Then came the other one and said: ‘Give me my trust.’

She said: ‘Your friend had taken it and mentioned that you had died.’

The issue was brought to Umar,

so he said to her: ‘I see that you are liable.’

The woman said: ‘Let Ali (AS) decide between me and him.’

Umar said [to Ali]: ‘Judge between them.’

Thus Ali said:

‘The trust is with me:

you both commanded that she should not give it to one of you

until both of you are brought together.

So bring me your friend!’

Thus he did not deem her liable [for it] and said: ‘They wanted to swindle her money.’ ”

A Man Whose Eye Was Injured

838. Al-Kafi, reporting from al-Hasan ibn Kathir, from his father, who said:

“A man’s eye was injured, while it appeared to be normal,

so the Commander of the Faithful (AS) commanded that the normal eye be blindfolded

and a person stand opposite to him with an egg in his hand, saying: ‘Can you see it?’

Whenever he said ‘Yes’, the man with the egg took a step backwards,

until it disappeared from his sight, and that spot was marked.

Then his injured eye was blindfolded,

and the man with the egg distanced himself while he looked with his normal eye until the egg disappeared from his sight.

The distance between the two spots was measured, and the man was given compensation (arsh)1934 for it.” [According to Islamic penal law “arsh” is the compensation payable in case of offences against the body (Editor).]

Two Men Contesting Each other’s Right

839. Al-Kafi, reporting from Ibn Abu Layla, who said:

“The Commander of the Faithful (AS) judged between two men who went on travel;

when they wanted to have lunch, one of them took out five loaves of bread from his provisions,

the other took out three loaves.

A wayfarer passed by them,

so they invited him to partake of their food.

The man ate with them until nothing was left;

when he finished, he gave them eight dirhams as a reward for what he had eaten.

The person with three loaves said to the one with five loaves:

‘Divide it equally between you and I.’

The possessor of five loaves said:

‘No, each one of us should take of the dirhams according to the provision he had taken out.’

He said: “They came to the Commander of the Faithful (AS);

when he heard their story, he said to them:

‘Reconcile for your case is contemptible.’

They said: ‘Judge between us with truth.’

He said: “He gave the owner of five loaves seven dirhams

and the owner of three loaves one dirham.”

He said: ‘Did one of you not take out five loaves

and the other three loaves?’

They said: ‘Yes.’

He said: ‘Did your guest not eat as much as you ate?’

They said: ‘Yes!’

He said: ‘Did you not eat, O owner of three loaves, three loaves except a third,

and you, owner of five loaves, eat three loaves except a third,

and the guest eat three loaves except a third?

Is a third left for you, O owner of three loaves, from your provisions

whereas you, O owner of five loaves, two loaves and a third remained with you,

and you ate three loaves except a third?!’

He gave for every third of a loaf a dirham,

so he gave the owner of two loaves and a third seven dirhams

and the owner of a third a dirham.”

840. Al-Kafi, reporting from al-Harith ibn Hasira, who said:

“I passed by an Abyssinian who was watering [his animals] in Medina

with his hand cut off.

I said to him: “Who cut your hand?”

He said:

‘The best of people cut my hand.

We were eight people arrested for stealing

and taken to Ali ibn Abi Talib (AS).

We confessed [to] the theft,

so he said to us: ‘Do you know that it is fordidden?’

We said: ‘Yes.’

He commanded that our fingers be cut from the palm,

and the thumb was spared;

then he commanded that we be held in a house

and fed on clarified butter and honey

until our hands were healed,

then he commanded that we be released

and clothed us with the best of clothes

and then said to us:

‘If you repent and make amends, it will be best for you,

and God will rejoin your hands to you in Paradise,

but if you do not, God will rejoin them to you in hell.’ ”
