248 - قِتالُ أهلِ البَغيِ مِنَ المُسلِمينَ
248. Fighting Against Muslim Aggressors
(وَإِنْ طائِفَتَانِ مِنَ الْمُؤْمِنِينَ اقْتَتَلُوا فَأَصْلِحُوا بَيْنَهُمَا فَإِنْ بَغَتْ إِحْدَاهُمَا عَلَى الْأُخْرَى فَقَاتِلُوا الَّتِي تَبْغِي حَتَّى تَفِيءَ إِلى أَمْرِ اللَّهِ فَإِنْ فاءَتْ فأَصْلِحُوا بَيْنَهُمَا بِالعَدْلِ وَأَقْسِطُوا إِنَّ اللَّهَ يُحِبُّ المُقْسِطِينَ) .1
"If two groups of the faithful fight one another, make peace between them. But if one party of them aggresses against the other, fight the one which aggresses until it returns to Allah's ordinance. Then, if it returns, make peace between them fairly, and do justice. Indeed Allah loves the just." 2
831.حَفْصُ بْنُ غِيَاثٍ : سَأَلتُ أبا عَبدِ اللَّه عليه السلام عَنِ الطّائِفَتَينِ مِنَ المُؤمِنينَ إحداهُما باغِيَةٌ وَ الأُخرى عادِلَةٌ فَهَزَمَتِ العادِلَةُ الباغِيَةَ ؟ فَقالَ : لَيسَ لأَهْلِ العَدلِ أَن يَتبَعوا مُدبِراً و لا يَقتُلوا أسيراً ولا يُجهِزوا عَلَى جَريحٍ ، و هذا إذا لَمْ يَبقَ مِن أهلِ البَغيِ أَحَدٌ وَ لَم يَكُن لَهُم فِئَةٌ يَرجِعونَ إلَيها .3
831. Hafs Ibn Ghiyath said, 'I asked Abu Abdullah [al-Sadiq] (AS) about two groups of believers; one group were rebels and the other group just, and the just group defeated the rebels.' He (AS) said, 'The just group does not have the right to chase the retrieving fugitive or to kill a prisoner or finish off a wounded person, and this is of course when nobody from the rebels are left and no formation from them exists to return so that those who have remained may join them.' 4
832.الإمام زين العابدين عليه السلام: إنَّ عَلِيّاً عليه السلام كَتَبَ إلى مالِكٍ - و هُوَ عَلى مُقَدِّمَتِهِ يَومَ البَصرَةِ - بِأَن لا يَطعُنَ في غَيرِ مُقبِلٍ و لا يَقتُلَ مُدبِراً وَ لا يُجيزَ عَلى جَريحٍ و مَن أغلَقَ بابَهُ فَهُوَ آمِنٌ .5
832. Imam al-Sajjad (AS) said, 'Imam Ali (AS) wrote to Malik al-Ashtar who was in the frontline in the battle in Basra, 'Do not fight those who are not advancing, nor should one who retreats be killed, nor should one finish off a wounded. He who closes the door of his house is safe.' 6
833.عَبدُ اللَّهِ بنُ شَرِيكٍ عَن أبيهِ : لمّا هُزِمَ النّاسُ يَومَ الجَمَلِ قالَ أميرُ المُؤمِنينَ عليه السلام : لا تَتبَعوا مُوَلِّياً ولا تُجيزوا عَلَى جَريحٍ ومَن أغلَقَ بابَهُ فَهُوَ آمِنٌ ، فَلَمّا كانَ يَومُ صِفّينَ قَتَلَ المُقبِلَ وَالمُدبِرَ وأجازَ عَلى جَريحٍ ، فَقالَ أبانُ بنُ تَغلِبَ لِعَبدِ اللَّهِ بنِ شَرِيكٍ : هذِهِ سيرَتَانِ مُختَلِفَتانِ ، فَقالَ : إنَّ أهلَ الجَمَلِ قَتَلَ طَلحَةَ وَالزُّبَيرَ وإِنَّ مُعاوِيَةَ كانَ قائِماً بِعَينِهِ و كانَ قائِدَهُمْ .7
833. Abdullah Ibn Sharik, narrating from his father, 'When the enemy was defeated in the Battle of the Camel, the Commander of the Faithful (AS) said that no one who has fled should be chased, and no one who has been wounded should be finished off, and he who closes the door of his house is safe. On the day of the Battle of Siffin those who had fought or turned away were killed and the wounded was finished off. Aban Ibn Taghlib said to Abdullah Ibn Sharik, 'These two methods are different.' Ibn Sharik answered, 'Those who are from the Battle of the Camel killed Talha and Zubayr, but in this battle Muawiya is still present and is himself leading them.' 8
