1831 - النَّهىُ عَنِ الإضرارِ وَالحَيفِ فِي الوَصِيَّةِ

1831. FORBIDDING CAUSING DAMAGES AND LOSSES IN ONE'S WILL

6512.الإمامُ عليٌّ عليه السلام : مَن أوصى‏ ولَم يَحِفْ ولَم يُضارَّ كانَ كَمَن تَصَدَّقَ بهِ في حَياتِهِ .¹

6512.Imam Ali (AS) said, 'He who leaves a will and does not wrong or damage is as though he gave it in charity during his lifetime.' ²

6513.الإمامُ عليٌّ عليه السلام : الحَيفُ في الوَصيَّةِ مِن الكَبائرِ .³

6513.Imam Ali (AS) said, 'Causing damages in one's will is among the grave sins.' ⁴

6514.الإمامُ الصّادقُ عليه السلام : مَن أوصى‏ بِالثُّلُثِ فَقَد أضَرَّ بِالوَرَثَةِ ، والوَصيَّةُ بِالخُمسِ والرُّبعِ أفضَلُ مِن الوَصيَّةِ بِالثُّلُثِ ، ومَن أوصى‏ بِالثُّلُثِ فلَم يَترُكْ .⁵

6514.Imam al-Sadiq (AS) said, 'He who leaves a will concerning the one third has wronged his heir, and leaving a bequest of a quarter or a fifth [of one's estate] is better than bequesting a third.' ⁶

402. THE WILL

1830 - الحَثُّ عَلَى الوَصِيَّةِ

1830. ENCOURAGING TO MAKE A WILL

(كُتِبَ عَلَيْكُمْ إِذَا حَضَرَ أَحَدَكُمُ الْمَوْتُ إِنْ تَرَكَ خَيْراً الْوَصِيَّةُ لِلْوَالِدَيْنِ وَالأَقْرَبِينَ بِالْمَعْرُوفِ حَقّاً عَلَى الْمُتَّقِينَ) .¹

"Prescribed for you, when death approaches any of you and he leaves behind any property, is that he make a bequest for his parents and relatives, in an honourable manner, an obligation on the Godwary." ²

6508.رسولُ اللَّهِ صلى اللَّه عليه وآله : الوَصِيَّةُ حَقٌّ على‏ كُلِّ مُسلمٍ .³

6508.The Prophet (SAWA) said, 'The will is incumbent upon every Muslim.' ⁴

6509.رسولُ اللَّهِ صلى اللَّه عليه وآله : المَحرومُ مَن حُرِمَ الوَصيَّةَ .⁵

6509.The Prophet (SAWA) said, 'The deprived one is he who has been deprived of [the opportunity to write] a will.' ⁶

6510.رسولُ اللَّهِ صلى اللَّه عليه وآله: ما يَنبَغي لامرئٍ مُسلمٍ أن يَبِيتَ لَيلَةً إلّا ووَصيَّتُهُ تَحتَ رأسِهِ .⁷

6510.The Prophet (SAWA) said, 'A muslim must not sleep a night without his will being beneath his head.' ⁸

6511.الإمامُ الباقرُ عليه السلام : مَن لَم يُوصِ عِندَ مَوتِهِ‏ لِذَوي قَرابَتِهِ مِمَّن لا يَرِثُهُ فَقد خَتَمَ عَمَلَهُ بمَعصِيَةٍ .⁹

6511.Imam al-Baqir (AS) said, 'Whoever does not leave a will for those of his family who do not automatically inherit him, his deeds end in disobedience [to Allah].' ¹⁰
